Kenyan Judges Uphold Child Safety, Reject Appeal of Man Guilty of Defiling a Child.

Ibrahim Maumo Malo has been found guilty of defiling an 11-year-old girl and infecting her with HIV back in 2015. He received a life sentence for this despicable act.

Recently, after serving nearly six years in prison, the 61-year-old man made a second appeal, citing his claimed reformation as grounds for a reduced sentence.

While Malo asserts that he has changed for the better, there is considerable doubt surrounding his claims. Given his disturbing history, many believe that he poses a grave danger to society, particularly to innocent children.

However, the Court of Appeal, which includes judges Patric Kiage, Francis Tuiyott, and Joel Ngugi, remained steadfast in their decision. They acknowledged Malo’s assertions of reform but ultimately deemed them unreliable.

Malo’s crime took place in Muhoroni Township, Kisumu County, where he repeatedly assaulted the child between January 1 and April 2, 2014.

Despite losing his initial appeal in the High Court, Malo pleaded with the court once more, emphasizing his age and the supposed claimed rehabilitation.

To support his case, Malo presented certificates demonstrating his completion of various vocational courses during his imprisonment, along with a commendation from the Officer-in-Charge at Kibos Maximum Prison, attesting to his positive behavior and participation in spiritual programs.

Nevertheless, the prosecution opposed Malo’s appeal, arguing for the retention of his life sentence due to the severity of his crimes and their profound impact on the victim, who was only 11 years old at the time of the assaults.

The court condemned Malo’s predatory behavior, noting his manipulation of the victim’s poverty through promises of small rewards and exploiting her vulnerability and innocence.

The judges highlighted a particularly disturbing incident where Malo lured the girl with the promise of money, only to violate her in a sugarcane field, subsequently losing the very money he had used to entice her, which was 30 Kenyan shillings (30 cents).
